Libertarian paternalism's notion of “nudging” refers to steering individual decision making so as to make choosers better off without breaching their free choice. If successful, this may offer an ideal synthesis between the duty to respect patient autonomy and that of beneficence, which at times favors paternalistic influence. A growing body of literature attempts to assess the merits of nudging in health care. However, this literature deals almost exclusively with health policy, while the question of the potential benefit of nudging (...) for the practice of informed consent has escaped systematic analysis. This article focuses on this question. While it concedes that nudging could amount to improper exploitation of cognitive weaknesses, it defends the practice of nudging in a wide range of other conditions. The conclusion is that, when ethically legitimate, nudging offers an important new paradigm for informed consent, with a special potential to overcome the classical dilemma between paternalistic beneficence and respect for autonomy. Alan Turing’s 1950 imitation game has been widely understood as a means for testing if an entity is intelligent. Following a series of papers by Diane Proudfoot, I offer a socio-technological interpretation of Turing’s paper and present an alternative way of understanding both the imitation game and Turing’s concept of intelligence. Turing, I claim, saw intelligence as a social concept, meaning that possession of intelligence is a property determined by society’s attitude toward the entity. He realized that as long as (...) human society held a prejudiced attitude toward machinery—seeing machines a priori as mindless objects—machines could not be said to be intelligent, by definition. He also realized, though, that if humans’ a priori, chauvinistic attitude toward machinery changed, the existence of intelligent machines would become logically possible. Turing thought that such a change would eventually occur: He believed that when scientists overcome the technological challenge of constructing sophisticated machines that could imitate human verbal behavior—i.e., do well in the imitation game—humans’ prejudiced attitude toward machinery will have altered in such a way that machines could be said to be intelligent. The imitation game, for Turing, was not an intelligence test, but a technological aspiration whose realization would likely involve a change in society’s attitude toward machines. (shrink)

In this volume, Rachel Giora explores how the salient meanings of words - the meanings that stand out as most prominent and accessible in our minds - shape how we think and how we speak. For Giora, salient meanings display interesting effects in both figurative and literal language. In both domains, speakers and writers creatively exploit the possibilities inherent in the fact that, while words have multiple meanings, some meanings are more accessible than others. Of the various meanings (...) weencode in our mental lexicon for a given word or expression, we ascribe greater cognitive priority to some over others. Interestingly, the most salient meaning is not always the literal meaning. Giora argues that it is cognitively prominent salient meanings, rather than literal meanings, that play the most important role in the comprehension and production of language. She shows that even though context begins to affect comprehension immediately, it does so without obstructing the early accessing of salient meanings. Thus, the meaning we first attend to is the salient word meaning, regardless of contextual bias. Knowledge of salient meanings turns out to play a major role, perhaps the most important role, in the process of using and understanding of language. Going beyond the familiar effects of literal meaning and context, the Graded Salience Hypothesis presents the most comprehensive explanation for how we use language for meaning. Normal meiosis consists of a single round of DNA replication followed by two nuclear divisions. In the 1st division the chromosomes segregate reductionally whereas in the 2nd division they segregate equationally (as they do in mitosis). In certain yeast mutants, a single‐division meiosis takes place, in which some chromosomes segregate reductionally while others divide equationally. This autonomous segregation behaviour of individual chromosomes on a common spindle is determined by the centromeres they carry. Individuals who show anger are rated as higher in dominance and lower in affiliation, whereas those who express sadness are rated lower in dominance and higher in affiliation. Little is known about situations where people show both expressions in sequence as happens when a first emotional reaction is followed by a second, different one. This question was examined in two studies. Overall, we found that the last emotion shown had a strong impact on perceived behavioural intentions. However, the information about (...) the previously shown emotion was also integrated. The specific mode of integration was dependent on the salience of the change and naive theories about the type of person who changes their emotion in the face of changing events. (shrink)

The Optimal Innovation Hypothesis, following from the Graded Salience Hypothesis, is being reviewed and revisited. The attempt is to expand the notion of Optimal Innovation to allow it to apply to both stimuli’s coded meanings as well as their noncoded, constructed interpretations. According to the Optimal Innovation Hypothesis, Optimal Innovations, when devised, will be more pleasing than nonoptimally innovative counterparts. Unlike such competitors, Optimal Innovations deautomatize familiar coded alternatives, which invoke unconditional responses alongside novel but distinct ones, allowing both responses (...) to interact. Conversely, the Revised Optimal Innovation Hypothesis, introduced and tested here, follows from the Defaultness Hypothesis. It posits that both default lexicalized meanings and default constructed interpretations might be qualifiable for Optimal Innovation once they are deautomatized by nondefault, context-dependent counterparts. Such nondefault Optimal Innovations will be pleasing, more pleasing than default and nondefault counterparts not qualifiable for Optimal Innovation. Results of two experiments support the Revised Optimal Innovation Hypothesis, while further corroborating the Defaultness Hypothesis. (shrink)

This paper presents a new approach to the demarcation of social emotions, based on their dependence on social appraisals that are designed to assess events bearing on social concerns. Previous theoretical attempts to characterize social emotions are compared, and their inconsistencies highlighted. Evidence for the present formulation is derived from theory and research into links between appraisals and emotions. Emotions identified as social using our criteria are also shown to bring more consistent consequences for social behavior than nonsocial emotions. Weiner’s attribution theory of motivation and emotion assumes emotions are determined by beliefs about causality. Individuals share a naïve understanding of this linkage between causal attribution and emotions and use it in order to draw inferences from and influence others’ emotions. Evidence for such uses is provided and recent research and theory that goes beyond the attribution–emotion linkage is discussed. Specifically, recent research considers the naïve use of a larger set of emotions and appraisals and their connections, and the role (...) of context in this process. However, still missing is a fuller understanding when this naïve knowledge is employed and how and when it is based on an explicit understanding of the emotion–appraisal linkage rather than more automatic processes. A longstanding debate exists in both academic literature and popular culture about whether non-informative marketing tactics are manipulative. However, given that we tend to believe that some marketing tactics are manipulative and some are not, the question that marketers, their critics, and consumers need to ask themselves is that of how to actually determine whether any particular marketing tactic is manipulative and whether a given manipulative tactic is, in fact, immoral. This article proposes to operationalize criteria that can be used (...) by marketers for making such determinations and attempts to provide some clarification toward our under- standing of the concept of manipulation and the conditions for the moral acceptability of manipulative marketing practices. It argues that a marketing tactic is manipulative if it is intended to motivate by undermining what the marketer believes is his/her audience’s normal decision-making process either by deception or by playing on a vulnerability that the marketer believes exists in his/her audience’s normal decision-making process. Such a tactic is morally objectionable on several grounds, which make it morally impermissible unless outweighed by sufficient “redemptive” moral considerations. (shrink)

The year 2009 marks the 400th anniversary of the publication of one of the most revolutionary scientific texts ever written. In this book, appropriately entitled, Astronomia nova, Johannes Kepler developed an astronomical theory which departs fundamentally from the systems of Ptolemy and Copernicus. One of the great innovations of this theory is its dependence on the science of optics. The declared goal of Kepler in his earlier publication, Paralipomena to Witelo whereby The Optical Part of Astronomy is Treated, was to (...) solve difficulties and expose illusions astronomers face when conducting astronomical observations with optical instruments. To avoid observational errors that had plagued the antiquated measuring techniques for calculating the apparent diameter and angular position of the luminaries, Kepler designed a novel device: the ecliptic instrument. In this paper we seek to shed light on the role optical instruments play in Kepler's scheme: they impose constraints on theory, but at the same time render astronomical knowledge secure. To get a comprehensive grasp of Kepler's astonishing achievements it is required to widen the approach to his writings and study Kepler not only as a mathematico-physical astronomer, but also as a designer of instruments and a practicing observer. We reviewed 272 phase I oncology trial consent forms and then created an improved informed consent template in both English and Spanish by redesigning and rewording the consent form to be specific to phase I trials, to avoid repetition, and to use simplified language, identifiable sections framed by first-person questions, and tables to present information. The resulting consent form template is shorter than average and considerably easier to read . The template also meets the recommended eighth-grade maximum reading level for (...) consent forms. Use of this template should help improve the informed consent process. (shrink)

The attempt to narrow the general discourse of the problem of error and to focus it on the specific problem of experimental error may be approached from different directions. One possibility is to establish a focusing process from the standpoint of history; such an approach requires a careful scrutiny of the history of science with a view to identifying the juncture when the problem of experimental error was properly understood and accounted for. There is a disturbing kind of situation that presents agents with only two possibilities of moral action—one especially praiseworthy, the other condemnable. I describe such scenarios and argue that moral action in them exhibits a unique set of parameters: performing the commendable action is especially praiseworthy; not performing is not blameworthy; not performing is wrong. This set of parameters is distinct from those which characterize either moral obligation or supererogation. It is accordingly claimed that it defines a distinct, yet unrecognized, (...) deontic category, to which the name ‘Forced Supererogation’ is appropriate. The moral parameters of Forced Supererogation and the relations between them are discussed, especially the divergence of wrongness and blame. I argue that this new category allows a more accurate classification of moral actions than that imposed by the strained dichotomy of obligation versus supererogation. (shrink)

John Rawls, father of contemporary distributive justice, professed the metaphysical neutrality of his theory, and formulated an additional theory to support such neutrality generally. This article exposes Rawls’s own theological underpinnings concerning his conception of the moral arbitrariness of existence, and his structural dichotomous approach for engaging it. I show how both of his theories are reminiscent of Calvin, employing methods of bifurcation, and thus generating tensions within both the concept of justice and moral personality. I end with analysis of (...) the relationship of this structural rationality to arbitrariness. This exposure of Rawls’s theological debt is part of a wider argument concerning the theological basis of distributive justice theory, and the relevance of Theology for philosophical ethics. The nonidentity problem is a deep puzzle challenging the moral intuition that what is bad must be bad for someone. The first part of the paper constructs a new theory of harming, whereas the second part builds on the conclusions of the first to offer a new solution to the NIP. The first part discusses the neglected question of when a burden inflicted in the context of overall benefitting can be discretized as a separate entity—only when it can, is it (...) possible to identify the burden as harm, and only then is it possible to harm in bringing into overall good existence. The second part explains how, in those cases where creating is indeed harming, we can use the logic of concept expansion to construct a concept of wronging that applies to creation cases. (shrink)

Recent research, especially with functional brain imaging, demonstrated cases where the administration of a placebo produces objective effects in tissues that are indistinguishable from those of the real therapeutic agents. This phenomenon has been shown in treatments of pain, depression, Parkinsonism, and more. The main ethical complaint against placebo treatment is that it is a kind of deception, where supposedly we substitute what works just psychologically for a real drug that actually works on the tissue level. We claim that the (...) scientific findings bring to a new level the seeming deconstruction of the distinction between “placebo” and “real” drugs, and that instances of placebo treatment which fulfill this criterion should be recognized as a unique category—we call it “comparable placebo treatment” (CPT). The paper uses an analysis of the notion of deception to argue that CPT does not amount to deception; that it can preserve patient autonomy; and that it is therefore morally legitimate. (shrink)
